Terms & Conditions

The agreement between you and NaviBoss. Written to be read: short sections, plain words, and the most important clause — that this is a planning aid and never a substitute for navigation — placed second rather than buried at the end.

1Who this agreement is with

These terms are between you and NaviBoss (“we”, “us”), of West Boxhill, Talisay City, Cebu, Philippines, which operates naviboss.app, the voyage planner at /app/, and the offline desktop edition described in §7. Contact: support@naviboss.app.

By using NaviBoss you accept these terms. If you are using it for an employer — a shipping company, a manager, an agency — you confirm you may accept them on that organisation's behalf, and “you” means both of you.

2NaviBoss is a planning aid, not a navigation system

NaviBoss must never be used for navigation. It is a passage-planning and voyage-estimation aid. It is not an ECDIS, it is not a chart system, it is not type-approved, and it carries no IMO, IHO or flag-state approval of any kind.

Routes are derived from a curated network of professionally recommended shipping lanes and are supplied for information only. They must not replace official charts, official nautical publications, Notices to Mariners, the judgement of the master, or the vessel's own approved passage plan. Distances, ETAs, chokepoint transits, risk and regulatory zones, depths and current or forecast data are all estimates and may be wrong, out of date, or incomplete.

The master and the bridge team remain solely responsible for the safe navigation of the vessel. Anything exported from NaviBoss — including RTZ files loaded into an ECDIS — must be verified against official sources before it is used.

Regulatory and risk zones in particular are reproduced from published sources such as IMO instruments and industry advisories and are rebuilt periodically. They are not a live feed, and their currency is not guaranteed. Treat them as a prompt to check the authoritative source, never as the source itself.

3What you may do, and what you may not

We grant you a personal, non-exclusive, non-transferable, revocable licence to use NaviBoss and to use the routes, distances and files it produces for your own voyage planning, including commercially aboard or ashore. Output you generate for your own voyages is yours to use.

You may not:

  • extract, scrape, copy, re-host or redistribute the underlying datasets — the routing graph, the port database and the zone compilations are our own compilations and are licensed to you for use through the product, not as data;
  • resell, sublicense or provide NaviBoss as a service to third parties, or build a competing routing or distance-table product from it;
  • reverse-engineer, decompile or defeat the licensing, trial or data protection in either edition;
  • use automated means to place load on the service beyond ordinary human use, or attempt to disrupt it for others;
  • remove or obscure attribution, or represent NaviBoss output as officially approved for navigation.

The software, design, brand and datasets remain ours. Third-party data used under its own licence — coastlines, port registries, forecast fields — remains the property of its source and is credited in the app under Settings › License & data.

4Plans, and what each one includes

The planner is free forever. No sign-up, no card, no expiry. Routing on real shipping lanes, blockable canals and straits, risk and regulatory zones, the currents overlay, voyage playback, opening a route file and sharing a voyage by link all stay free permanently.

Your first 7 days include everything. The trial is anonymous and clocked in your browser; it needs no account and asks for nothing. When it ends you are not locked out — you move to the free tier, and only two things are withheld: exporting routes to your ECDIS, and keeping more than one saved voyage at a time.

Paid plans lift both, at $12 per month or $97 per year. Prices are in US dollars and exclude any tax that applies where you are; the peso price on /PHcheckout is set separately. We may change prices, but never for a subscription already running — a change takes effect at your next renewal, and we will tell you before it does.

5Payment

Card checkout

Card payments are handled by Dodo Payments, who act as merchant of record. That means your contract for the purchase itself is with them, they are the party on your statement, and their terms and refund handling apply alongside these. We never receive or store your card details. Subscriptions renew automatically until cancelled.

Philippine peso payments

/PHcheckout exists because many Filipino seafarers hold no international card. You send payment by GCash or bank transfer and file a claim with your name, email and the amount; we match it by hand and unlock your account. Two things follow from it being manual: approval is not instant — allow for a working day — and a payment we cannot match to a claim cannot be credited. If we cannot match yours, write to us and we will refund it rather than keep it.

6Cancelling, and refunds

Cancel whenever you like. Access continues to the end of the period you have paid for, and nothing renews after that. Cancelling does not delete your voyages — they are in your browser, not on our servers.

Payments are not refunded. Cancelling always leaves you the time you have already paid for, so there is nothing unused to return. Try the planner before you buy: the seven-day trial is the whole application, with no card and no account, and it exists so that nobody has to pay in order to find out whether this is useful.

Two things sit above that paragraph. Payments are taken by Dodo Payments as the seller of record, and their own refund process applies to the transaction whatever this section says. And where the law gives you a cancellation or withdrawal right as a consumer — the EU and the UK both do for distance contracts — you keep it in full. Nothing here limits a right you hold by statute.

We may suspend or end access, with the unused part refunded, if these terms are seriously or repeatedly broken — chiefly the restrictions in §3.

7The offline desktop edition

An offline desktop edition — the whole application on an onboard PC with no internet at all — is built and running, but it is not on sale. There is no installer, no licence and no way to buy it. The “join the waitlist” link on the pricing section registers interest and nothing more: it takes no money, creates no contract, and is not a pre-order. Any pricing mentioned around it is indicative and not an offer.

8Availability and changes to the product

We aim to keep NaviBoss available and current, but we do not promise uninterrupted service and there is no service-level agreement. The planner runs in your browser, so a brief outage of our hosting does not stop a page you already have open — but loading it fresh, signing in and buying all need the network.

Features and data may change. We may add, alter or withdraw parts of the product; where a change materially reduces what a paid plan includes, you may cancel and we will refund the unused part.

9Your data

Your voyages, settings and saved work stay in your own browser and are never uploaded — which also means they are yours to look after: clearing your browser storage deletes them, and we hold no copy to restore. Export anything you need to keep.

What we do receive, who else processes it and how to have it deleted is set out in full in the Privacy Policy, which forms part of these terms.

10No warranty

NaviBoss is provided “as is” and “as available”. To the fullest extent the law allows, we exclude all warranties, conditions and terms implied by statute or common law — including any as to merchantability, fitness for a particular purpose, accuracy, or non-infringement.

In particular, and without limiting §2, we do not warrant that routes, distances, ETAs, transits, zones, depths, currents or forecasts are accurate, complete or current, nor that the service will be error-free or uninterrupted.

11Limitation of liability

Nothing here limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.

Subject to that, we are not liable for indirect or consequential loss, nor for loss of profit, revenue, charter hire, cargo, business, goodwill or data, however arising. We are not liable for any loss arising from use of NaviBoss for navigation, which §2 prohibits, nor for any grounding, collision, detention, delay, deviation, fine, pollution incident or other casualty.

Our total liability to you for all claims in any 12-month period is limited to the amount you actually paid us in that period — which, on the free tier, is nothing.

12Governing law and disputes

These terms are governed by the laws of the Republic of the Philippines, and the courts of the Philippines have exclusive jurisdiction over any dispute arising from them.

If you are a consumer resident in the EEA or the UK, this does not deprive you of the protection of the mandatory consumer law of the country you live in, or of your right to bring proceedings there.

Please write to support@naviboss.app before starting anything formal. Most things are a misunderstanding and are fixed in one email.

13Changes, and the rest

We may update these terms. The date and version at the top change when we do, and a material change affecting a paid plan will be notified by email before it takes effect. Continuing to use NaviBoss after that means you accept the new version.

If a clause turns out to be unenforceable, the rest stands. Not enforcing something once does not waive it. You may not transfer your rights under these terms without our agreement; we may transfer ours if the business is sold, on notice. Together with the Privacy Policy, this is the whole agreement between us.
